The Federal High Court, Abuja, has refused to order the federal government to release Abba Kyari, the suspended Deputy Commissioner of Police (DCP) detained by the National Drug Law Enforcement Agency (NDLEA).
Kyari, through an ex-parte application delivered to the court by Cynthia Ikene, his counsel, pleaded to be freed on a liberal condition. Ikene told the court on Monday that Kyari is diabetic and hypertensive and as such needs to be released immediately for medical attention.

However, Justice Inyang Eden Ekwo, who handled the case, turned down the application and advised Kayri to notify the federal government of his application, according to The Cable.
“Upon studying the process of the applicant and the averments in support of the application, I am of the opinion that the respondents be put on notice so they can answer to the averments. Therefore, the applicant is hereby ordered to put the respondents on notice of all the processes in this matter,” he was quoted to have said.

Ekwo sensed that Kyari’s allegations against the federal government were cumbersome. He said there was a need to hear from the government.
Ekwo also ruled that parties involved appear before his court on February 24.
