03.08.2021 Justice FirstNation Airway’s Kayode Odukoya Tells Court He Has No EFCC to Answer

A Special Offences Court sitting in Ikeja, Lagos, has adjourned the ‘no case submission’ filed by Kayode Odukoya, Chief Executive Officer of the now defunct First Nation Airways Limited, FIJ understands.

Kayode who was re-arraigned alongside his company by the Economic and Financial Crimes Commission, EFCC, in November 2020 is standing trial for a seven-count charge bordering on forgery, use of false document, perjury, stealing and obtaining credit by fraud, among others.

He had pleaded not guilty to the charges and filed a ‘no case submission’ –⁠ legal term for a plea to the court to discharge a case without requesting for a defence. During the sitting on Kayode’s submission on Monday, Edoka Onyeke, the defence counsel, urged the court to “dismiss the seven-count charge and discharge the defendant.”

However, A. B. C. Ozioko, the prosecuting counsel  argued that the no-case submission of the defence” was not whether the defendant was guilty or innocent”. Ozioko said that all Kayode needed to do was to enter his defence and explain things to the court.

The presiding Justice Mojisola Dada adjourned the sitting to October 22, 2021, for ruling on Kayode’s no case submission.
