The National Association of Resident Doctors (NARD) has moved to appeal a court order mandating it to suspend its ongoing strike with immediate effect.

In a statement released on Friday, the association said its fundamental human right has been breached.

“As we are aware, especially those that were in court today, the NIC has given a ruling on the application for interlocutory injunction filed by the federal government,” the statement read in part.

“We are not satisfied with the ruling. After consultations with our lawyers, we have directed our lawyer to appeal the ruling and file application for stay of execution.”

On Monday, August 2, the doctors had declared an indefinite strike to demand an increment in their hazard allowances and payment of outstanding salaries. In response to this, the federal government filed a lawsuit against the union and, on Friday, the National Industrial Court (NIC) ordered the immediate suspension of the strike.

NARD said the NIC ignored its notice of preliminary injunction challenging the jurisdiction of the court and proceeded to grant the government’s application for interlocutory injunction.
