01.09.2023 Featured After Receiving N57.5m for 5-Bedroom Duplex, Beachway Homes Asks Client to Terminate Contract

On July 11, Beachway Homes, a Lagos-based property development company, wrote to its client, Imo Ukpong, to terminate his contract with them.

It was the last of several moves that Beachway had made to deny Ukpong ownership of a five-bedroom semi-detached duplex which he bought in the company’s Serene Court 1 Estate in November 2022 for N56 million.

“The new owner, as the assignee, has not paid any N56 million to Beachway or to Mr. Lawal as the proxy “assignor”. While understanding that the new owner is using this means to avoid applying for governor’s consent twice, it will not be in the best interest of Beachway or Mr. Lawal to acknowledge receipt of this purchase price when no such purchase price was paid to either Beachway or to Mr. Lawal,” the company had written to him in a previous email denying receipt of the N56 million which he paid them.

In an earlier notice, they had informed him that although Beachway had built the property, Razaq Lawal was the original landowner and would be the one to transfer the title.

It was after Ukpong expressed concerns about certain terms in the contract of sale and deed of assignment, including the assignor’s imposition of charges and levies in perpetuity on Ukpong even after transfer of ownership and title to the property, that the discord between him and the company began.

Beachway began to make false assertions in contrast to several receipts, emails and documents shared between them and Ukpong.

First, they denied receiving N56 million from Ukpong for the property. Meanwhile, Ukpong not only paid N56 million to Beachway, he also paid an additional N1.5 million as documentation fee making a total of N57.5 million paid to the company for which they issued him receipts.

Then they claimed that Ukpong conducted his transactions with one Wole Adeniyi despite having traded documents with him in which it was clearly stated that his transaction was with Beachway and Lawal.

And in a final draw, they asked Ukpong to terminate his contract with them.

Ukpong reported the case to the Lagos State Real Estate Regulatory Authority (LASRERA) before Beachway made a U-turn and asked for a meeting with his lawyer to resolve the points of departure and finalise the issuance of the title documents so that Ukpong could proceed to apply for the governor’s consent for his property.

Beachway, however, failed to provide a resolution after Ukpong’s lawyer insisted that they expunge the dubious clauses in the deed of assignment and contract of sale.

Beachway has failed to provide Ukpong with the title documents, signed deed of assignment, and Form 1C for his property. They have also failed to furnish him with the assignor’s tax clearance certificate so that he may process the governor’s approval for the property, despite receiving N57.5 million from him.

On Thursday, FIJ called Yinka Lawal, the chief executive officer of Beachway Homes, and received no response. Text messages sent to both his phone lines as well as a WhatsApp message sent to him had not been responded to at press time.
