26.11.2022 Featured Bibi’s Clover Delivers Defective Gown to Customer, Tells Her to Repair It

Chika Mercy, a Lagos State resident, has narrated to FIJ how Abisola Oguntonade, owner of Bibi’s Clover, an online clothing store, delivered a poorly sewn gown to her on Tuesday.

Mercy said she purchased the gown on Saturday, November 19, 2022, but when it was delivered to her three days later, she noticed the quality and colour differed from what she had seen online and there were stitches on the gown’s belt.

These stitches, according to Mercy, hung loosely off the belt, and were done with black threads on the blue gown. When she confronted Oguntonade over it, the vendor said “no one has ever complained” and then asked her to repair the tears.

Speaking to FIJ, Mercy said, “I ordered for wears online, but the vendor delivered another thing, and she is even abusing me.

“I went to her page last weekend after my friend referred her, and I said I wanted to buy a gown for a photoshoot. She told me it would take three days to deliver, but I asked if she could deliver on Monday. She said she could not, so I agreed to wait, I even shifted my photoshoot.

“On Saturday, I paid N4,800 for the gown, and sent her the delivery details. She asked that I pay N1,500 to the delivery guy when he came, and I waited. When the delivery guy came, the gown I saw was not what I ordered. Earlier, I wanted to go and pick up my order, but she said she did not have a physical shop.”

Mercy said she tested the gown and found the defect on its belt. She said she also compared what was delivered with what she saw online and found that they were different in colour and design.

She confronted Oguntonade over this, but the vendor said there was nothing she could do.

FIJ called Oguntonade on Friday, and she said, “That was what she ordered for. What she paid for was what I posted on my page, and that is what I delivered to her.

“On top of N4,800, that is why she is making this noise? If it is the belt, it is something she can go and fix with her money. It will not cost her much to fix it.”

FIJ found that Oguntonade’s actions contravene chapter 2 of the Federal Competition and Consumer Protection Act 2018 (FCCPA).

The FCCPA provides that the consumer has a right to services performed in a manner and quality that “reasonable persons” are generally entitled to expect.

In relation to the quality of goods, the FCCPA states, amongst others, that every consumer has a right to goods that are of good quality, in good working order, free from defects, and that comply with any applicable standards set by the industry sector regulator.

In addition, there is an implied warranty in any transaction that the goods comply with good quality and applicable standards set out in the FCCPA, and the customer has a right to return the goods within a prescribed period for failure to comply with the foregoing.
