01.11.2023 Featured Nigerian Pharmacist Wins Racial Harassment Case Against UK Employer

Samson Famojuro, a Nigerian pharmacist, has won a racial harassment case against Boots Pharmacy, his former employer.

Popularly known as Boots, the company is one of the biggest health care outfits in the United Kingdom.

According to the Daily Mail UK, Famojuro, who began working as a relief pharmacist for Boots in 2012, was assigned to work at the firm’s Wickford branch in Essex on July 18, 2020.

The pharmacist worked the shift with Emma Walker, a technician, and Nicole Daley, a pharmacy assistant. Walker and Daley were two white women who were junior officers to Famojuro within the organisation.

While attending to a customer, Famojuro made a work-related request to Daley, but the latter refused to attend to it, snapping at the Nigerian in front of many customers.

Famojuro later reportedly sought audience with Daley so the issue could be discussed and resolved, but Daley again turned down his request, claiming he had “a very loud and aggressive tone”.

The assistant also claimed the pharmacist was standing too close to her during the exchange and then left his presence.

Daley then began to cry, and then Walker stepped in. Rather than mediate between the two, Walker shouted at Famojuro and ordered him to leave the pharmacy despite not having the authority to do so. She further threatened to call the police if the Nigerian pharmacist would not leave.

Walker then further phoned one Amy Munson, another white store manager. Without listening to Famojuro’s side of the story, Munson reportedly shouted at the Nigerian over the phone, saying he was an utter disgrace for making Daley cry.

Famojuro ended up leaving the store in humiliation. He later resigned and sued Boots after the results of a lengthy investigation initiated by the firm were not made known.

While the matter was being heard in court this week, Walker claimed she only tried defending Daley by threatening to get the police to arrest the pharmacist during the incident.

While delivering judgement, however, David Massarella, the presiding judge, declared that Famojuro had been racially harassed.

“Mrs Walker, Ms Daley and Ms Munson treated him (Famojuro) adversely, both in front of customers and in their absence,” Massarella said.

“The treatment escalated as the day went on, from dismissive discourtesy, to open insubordination, to highly personalised abuse. Mrs Walker’s threat to call the police was the most extreme of the acts.

“For a black man to be reported to the police for aggression against two white women in the absence of any third-party witnesses is potentially a very serious matter indeed.

“We have no doubt that, subjectively, he found their treatment of him distressing and humiliating. By the end of the day, he was shaken and feared for his safety.

“Mr. Famojuro is an experienced professional of many years’ standing; he is a dignified, sensitive and courteous man. It was clear to us that the events of that day had a very grave effect on him.”

The tribunal also found both Walker and Daley to have given distorted and exaggerated accounts of what happened, successfully stereotyping the pharmacist as an “aggressive black man”. It was also concluded that the women had racially profiled Famojuro.

The Nigerian pharmacist’s compensation is to be decided at a later date.
